摘要
在高速城市化和城市多元权益结构形成的背景下,邻避设施兴建表面上可能触发环境污染、日照通风、房产贬值、心理嫌恶等相邻关系纠纷,实质则是城市空间利益正当分配问题。通过诠释邻避纠纷的公力救济困境与司法审查局限,进而说明作为空间资源分配的城市规划决策过于依赖技术标准,导致城市空间利益分配过程中"不要建在我家门口"的邻避现象频发。无论是技术标准主导的行政决策,还是中立客观的司法裁判,均无法独立实现城市空间利益的正当分配,而是需要"技术标准——公众参与——行政裁决——司法救济"这一连串的机制予以保障。
Under the background of rapid urbanization and the formation of diversified rights structure in cities,constructing NIMBY facilities seems to trigger disputes in neighborhood over pollution,sunlight,air ventilation,house devaluation,and psychological aversion,etc.,but actually all the disputes involve the issue of the legitimate distribution of urban spatial interests.By revealing the dilemma of public remedy and the limitation of judicial review in NIMBY disputes,it is further explained that the urban planning decision-making responsible for allocating spatial resources relies too much on technical standards,leading to the frequent occurrence of NIMBY phenomenon in the process of distributing urban spatial interests.Neither technical-standard-dominated administrative decision nor impartial judicial judgement can independently realize the legitimate distribution of urban spatial interests.The legitimate distribution should be guaranteed by a series of mechanisms:technical standard,public involvement,administrative adjudication,and judicial remedy.
