摘要
算法因其具备运行高效化和自我决策最优化的能力正引领当前社会步入算法治理时代。但也引发了有关人类决策不自主、个体价值判断不独立以及法律主体一元论被动摇的危机。就已有针对算法实体的主体理论展开辨析,从法律层面分析对算法予以规制之合理性,以及探讨理论界是如何对待算法实体将要被赋予法律人格这一问题。对算法治理所引发的人类主体权利失衡问题,国家权力应当采取措施予以规范平衡,对于法律主体地位的赋予要符合相关伦理原则和人格高贵的原则。
The algorithm is leading the current society into the era of algorithm governance because of its high efficiency and self-decision-making optimization ability.However,it also leads to the crisis that human decision-making is not independent,individual value judgment is not independent and the monism of legal subject is shaken.This paper has analyzed the subject theory of the algorithm entity,analyzed the rationality of the regulation of the algorithm from the legal level,and discussed how the theoretical circle treats the problem that the algorithm entity will be endowed with legal personality.For the imbalance of human subject rights caused by the above algorithm governance,the state power should take measures to regulate the balance,and the granting of legal subject status should conform to the relevant ethical principles and the principle of personality nobility.
