摘要
《职业教育法》修订自2008年列入立法规划,直到2022年4月审议通过,修订历时14年。以历史制度主义的视角,运用历史分析范式梳理修法历程,从时间序列和轨迹维度将其分为充分酝酿期、反复磋商期、重新启动期、加速完成期四个阶段。聚焦修法的基本逻辑,分析认为:修法体现了吸纳新思想、关照各方利益、凝练经验做法、回应社会关切等特点。逐条比对原《职业教育法》,新《职业教育法》在强化党的领导、明确概念、强化类型、贯通体系、理顺体制、企业主体、产教融合、提升质量等方面呈现鲜明特征。
Vocational Education Law was included in the legislative plan in 2008.Through 14 years’revision,it was finally deliberated and adopted in April 2022.From the perspective of historical institutionalism,the author reviews the process of revision with historical analysis paradigm,and divides it into full gestation period,repeated consultation period,restart period and accelerating completion period from time series and track dimension.The author holds the thought and logic of revision,and puts forward the characteristics of revision composed of embodying new ideas,taking care of the interests of all parties,condensing experience and responding to social concerns by analysis.The author compares the revised version to original version,and expounds on the contents of the new revision from the angles of defining concept,strengthening type,connecting system and smoothing system.
