摘要
公安机关刑事专项行动是一种具有人治色彩的打击犯罪模式,是公安机关在资源有限的情况下、在转型社会复杂环境下作出的无奈、经济的选择。调查发现,公安机关的专项行动存在以下问题:案件数量陡增但办案质量下降;浪费了有限的司法资源;侵害了犯罪嫌疑人的合法权益;治理流于形式效果欠佳等。所以,检察机关应当保持监督者理性,对公安机关专项行动建立监督机制,探索实行全程监督,将公安机关专项行动纳入法治轨道。
Criminal special action of public security organ is a mode of attacking crime featured in ruling by man and the economical choice that public security organ had to do under the background of limited resources and complex social transformation period. Several problems were discovered that cases are increasing but case handling quality is decreasing; limited judicial resources are wasted;legislative rights and interests of the suspect are violated; governing becomes a mere formality and responds worse. So procuratorial organ should be rational as supervisor,build supervision mechanism on special action,explore to carry out full- range supervision and bring special action into the orbit of ruling by law.
